A Case Study -
An exporter of heavy machinery subcontracted the packaging and shipment of equipment to a specialist packing and transport company. When the equipment arrived in the Far East it was rusty and unusable. The packing company sought to exclude its liability for the damage by the use of exclusion clauses in its so called "standard terms and conditions of trade". We successfully defeated these arguments and our client recovered the full cost of the damage to the equipment
