Employment Tribunal fees have caused controversy since their introduction in July 2013.
The union Unison have been one of the most vocal critics of the fees, and have taken legal action seeking abolishment of the fees. Fees were introduced with the intention of deterring spurious claims but it Unison belief that the fees limit access to justice for many legitimate claimants.In August 2015, the Court of Appeal rejected Unison’s appeal against the rules. The case was referred to The Supreme Court for review.
On 26th February, The Supreme Court granted Unison permission to appeal the Court of Appeal’s August decision.
The case introduces some uncertainty to the future of Tribunal fees, and we await future developments with interest.
